Acceptance of Terms

By accessing or using the website at https://coachingfamilylaw.com/ (the “Site”) and/or by engaging with Kathy J Ellis Coaching (“I,” “me,” “my,” or “Coach”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the Site or engage my services.

I may update these Terms from time to time. The version posted on the Site with the “Effective Date” above is the current version. Your continued use of the Site or my services after changes constitutes acceptance of the updated Terms.

Nature of Services; No Legal or Therapeutic Relationship

Kathy J Ellis Coaching provides coaching, consulting, education, and support to family law attorneys and related professionals. I am a coach and former therapist, but in this practice I do not:

  • Provide legal advice, legal representation, or any service that constitutes the practice of law.
  • Provide therapy, mental health treatment, diagnosis, or clinical services.
  • Create an attorney–client, therapist–patient, or HIPAA‑covered relationship.

Nothing on the Site or in any coaching engagement:

  • Substitutes for advice from a licensed attorney in your state or jurisdiction.
  • Substitutes for mental health treatment, crisis intervention, or medical care.
  • Creates a privileged or confidential relationship protected by law.

You remain solely responsible for your legal work, professional decisions, client relationships, and compliance with all applicable laws, court rules, and professional conduct rules.

Eligibility

By using the Site or my services, you represent that:

  • You are at least 18 years old.
  • You have the authority to enter into these Terms on your own behalf or on behalf of your firm or organization.
  • You will not use the Site or services for any unlawful purpose or in violation of any applicable laws or professional rules.

Website Use and Intellectual Property

License to Use Site Content

All content on the Site (including text, graphics, logos, images, audio, video, worksheets, templates, and other materials) is owned by or licensed to Kathy J Ellis Coaching and is protected by copyright and other intellectual property laws.

You are granted a limited, non‑exclusive, non‑transferable, revocable license to:

  • Access and view the Site for your personal or professional use.
  • Download or print reasonable portions of content for your own internal use in connection with coaching.

You may not:

  • Republish, sell, resell, distribute, or commercially exploit any Site content.
  • Create derivative works based on Site content without my prior written permission.
  • Use any automated systems (e.g., bots, scrapers) to access or extract data from the Site.

Trademarks

“Kathy J Ellis Coaching” and any related logos or brand names are trademarks or service marks of Kathy J Ellis Coaching. You may not use these marks without my prior written permission.

Coaching Services; Separate Agreement

The Site may describe coaching services, programs, packages, or offerings. However:

  • A coaching relationship is created only when we both sign a separate Coaching Services Agreement (or equivalent written agreement) and any required payment or enrollment conditions are satisfied.
  • These Terms govern your use of the Site and certain general aspects of our relationship. Still, the Coaching Services Agreement controls the specific terms of coaching (fees, schedule, cancellation, detailed confidentiality, etc.).
  • In the event of a conflict between these Terms and a signed Coaching Services Agreement, the Coaching Services Agreement controls for the services it covers.

Payments, Billing, Refunds, and Cancellations

Payment Processors; Currency

Fees for coaching services are as stated in your Coaching Services Agreement, invoice, or on the Site at the time of purchase. Payments are processed through third‑party payment processors such as PayPal and WISE, in U.S. dollars.

By making a payment, you:

  • Represent that you are authorized to use the payment method provided.
  • Agree to pay all applicable fees, taxes, and charges associated with your purchase.
  • Acknowledge that transactions may involve currency conversion and that the payment processor determines exchange rates and fees.

Refunds and Cancellations (Standard Policy)

Unless your Coaching Services Agreement states otherwise:

  • You may cancel or reschedule a session at least 24 hours before the scheduled start time.
  • Sessions canceled with less than 24 hours’ notice, or missed without notice, may be charged in full.
  • Refunds for packages or prepaid services are handled case‑by‑case and are not guaranteed unless required by law.

Scheduling is managed through TidyCal (or a similar tool). Your booking via TidyCal constitutes acceptance of the scheduling and cancellation terms disclosed at the time of booking.

Disclaimers; No Guarantees

The Site and coaching services are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non‑infringement.

I do not guarantee that:

  • The Site will be uninterrupted, error‑free, or completely secure.
  • Coaching will produce any specific professional, financial, personal, or case‑related result.
  • Any information on the Site will be complete, current, or applicable to your situation.

Testimonials, examples, and stories reflect individual experiences only and are not guarantees or predictions of your results.

Limitation of Liability

To the maximum extent permitted by law:

  • Kathy J Ellis Coaching, its owner, and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business, or goodwill, arising out of or related to your use of the Site or coaching services.
  • My total liability to you for any claim arising out of or related to the Site or coaching services shall not exceed the total amount you have paid me for coaching services in the six (6) months preceding the event giving rise to the claim, or USD $100, whichever is greater, unless law requires a higher amount.

Some jurisdictions do not allow certain limitations of liability; in those cases, some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Kathy J Ellis Coaching, its owner, and its affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site or coaching services.
  • Your violation of these Terms.
  • Your violation of any law, regulation, or professional rule.
  • Your disclosure of confidential or third‑party information in connection with coaching.

Privacy and Confidentiality

My handling of your personal information is described in my Privacy and Confidentiality Statement, which is incorporated into these Terms by reference.

Key points:

  • I do not sell your personal information.
  • I use service providers (e.g., email, scheduling via TidyCal, payment processors PayPal and WISE, video conferencing via Zoom, storage) who may process your data on my behalf under contractual obligations to protect it.
  • Coaching communications are treated as confidential in line with stringent professional coaching ethics (including the ICF Code of Ethics) and comparable mental health confidentiality norms, but are not protected by attorney–client privilege or therapist–patient privilege unless a separate written agreement explicitly provides otherwise.
  • Confidentiality is subject to the limits described in the Privacy and Confidentiality Statement (e.g., imminent risk of serious harm, legal requirements, mandated reporting, defense of legal rights, ongoing serious crimes).

Please review the Privacy and Confidentiality Statement carefully; it forms part of your agreement with me.

Third‑Party Links and Tools

The Site and services rely on third‑party platforms, which may include:

  • Payment processors: PayPal, WISE.
  • Scheduling: TidyCal.
  • Video and voice sessions: Zoom (and, if used in the future, similar platforms).
  • Email and office tools.

I do not control these third parties and am not responsible for:

  • Their content, accuracy, security, or privacy practices.
  • Any damages or losses arising from your use of them.

Your use of third‑party services is subject to their own terms and policies.

Prohibited Uses

You agree not to:

  • Use the Site or services for any unlawful purpose or to promote illegal activity.
  • Harass, threaten, defraud, or harm me, my staff, or other users.
  • Attempt to gain unauthorized access to the Site, servers, or systems.
  • Transmit viruses, malware, or any code of a destructive nature.
  • Impersonate any person or entity or misrepresent your affiliation with me.
  • Use the Site to violate any professional conduct rules or confidentiality obligations owed to your clients, firm, or others.

Changes to the Site and Services

I may:

  • Modify, suspend, or discontinue any part of the Site or services at any time, with or without notice.
  • Add or remove features, programs, or offerings.

I will not be liable to you or any third party for any modification, suspension, or discontinuation of the Site or services, except as expressly stated in a signed Coaching Services Agreement or required by law.

Governing Law; Venue; Dispute Resolution

Governing Law

These Terms and any disputes arising out of or related to the Site or coaching services shall be governed by the laws of the State of Washington, United States, without regard to its conflict‑of‑law principles.

Venue; Jurisdiction

Any legal action or proceeding arising out of or related to these Terms or the Site shall be brought exclusively in the state or federal courts located in King County, Washington, United States, and you consent to the personal jurisdiction of those courts.

Informal Resolution

Before filing any claim, you agree to first attempt to resolve the dispute informally by contacting me at kathyje@sbbmail.com and describing the issue in good faith. I will respond within a reasonable time and attempt to resolve the matter through good‑faith discussion.

No Class Actions

To the extent permitted by law, any dispute must be brought on an individual basis and not as part of a class, collective, or representative action.

International Use; Compliance

The Site is operated by a U.S. sole proprietor with a mailing address in Washington State, though I may physically be located in Italy or elsewhere at times. If you access the Site from the United States or another jurisdiction, you are responsible for compliance with all applicable local laws and professional rules.

You represent that:

  • You are authorized under your local laws and professional rules to engage a coach for the purposes described on the Site.
  • Your use of the Site and services does not violate any applicable law, regulation, or professional conduct rule in your jurisdiction.

Miscellaneous

Entire Agreement

These Terms, together with the Privacy and Confidentiality Statement and any signed Coaching Services Agreement, constitute the entire agreement between you and Kathy J Ellis Coaching regarding the Site and services, and supersede any prior or contemporaneous agreements or understandings.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

Waiver

My failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by me.

Assignment

You may not assign or transfer your rights or obligations under these Terms without my prior written consent. I may assign my rights and obligations without your consent in connection with a merger, sale of assets, or other business transfer.
